The mechanism

Article IV / VII · What SAR is. The DRC designates strategic assets for US-first access. Governance sits with the Joint Steering Committee.

The waterfall · US persons first. A 3 month proposal window, then a 3 month negotiation window, renewable once. Roughly 6 months of exclusivity inside a 9 month total before aligned persons enter. Anything unresolved at 12 months returns to the JSC.

Article IV · The prohibition. No asset may be designated if it breaches DRC domestic law or an international obligation. This is the live Rubaya and Manono test.

Ownership ratchet · Non-aligned equity cap. Steps down 40, 30, 20, 10 percent across years 5, 10 and 20.

Article VI · Governance. Joint Steering Committee. Inaugural meeting 5 February 2026.
